You must be at least the age of majority in your jurisdiction (typically 18) to use Tabinu; minors under 13 may not use the Service at all. Users under 18 must have parental or guardian consent. This aligns with GDPR, which requires parental consent for users under 16, and COPPA, which forbids collection of data from children under 13. By registering, you represent that you meet these age requirements and will comply with all local laws.
You agree to provide complete and truthful account information (name, email, social media links, etc.) and to keep it updated. You are responsible for all activity on your account (including maintenance of your password). You may not impersonate others, share accounts, or use automated means to access Tabinu.
You agree to use Tabinu only for lawful purposes. You will not post illegal content or engage in any fraudulent, harassing, infringing or offensive activities. Harassment, hate speech, bullying, or threats toward others are prohibited. You must comply with all applicable laws (including intellectual property and advertising laws) when using the platform.
You retain ownership of any content you upload or submit (campaign materials, media, messages, etc.). However, by using Tabinu you grant Tabinu a non-exclusive, royalty-free, worldwide license to use, display and distribute that content as needed to provide the Service. You represent and warrant that you own (or have permission to use) all content you post, and that it does not infringe any third-party rights. Tabinu may use your content (including reviews or ratings) for promotional purposes as allowed by these Terms.
You must not post content that is unlawful, infringing, defamatory, obscene, pornographic, violent or otherwise objectionable. For example, Tabinu expressly forbids disallowed content such as graphic violence, hate speech, sexual content, or any material that violates someone else's rights. Sponsored or paid content must be clearly disclosed (e.g. using "#ad" or similar) in compliance with advertising regulations. You shall not collect or scrape information about other users without consent. Tabinu reserves the right to remove or disable access to any content that violates these rules or is reported as infringing or illegal.
Tabinu complies with U.S. copyright laws and the DMCA. If copyrighted material is posted without authorization, copyright owners may submit a takedown notice. In accordance with the DMCA's "safe harbor" provisions, Tabinu will expeditiously remove infringing content upon notice to limit liability. Repeat infringers may have their accounts terminated.
All campaign fees and any subscription charges are handled through third-party payment processors (currently Stripe). Tabinu does not collect or store your credit card or banking details. Stripe is a PCI Service Provider Level 1 (the highest) for payment security, and any payment data is subject to Stripe's policies. (Tabinu will share only the data necessary to process payments, such as transaction amounts and user identity.)
Tabinu may charge service fees (e.g. a percentage commission on each completed campaign) and/or subscription fees for premium features. All applicable fees (and any changes) will be disclosed in advance on the website or during purchase. Brands and influencers are responsible for paying agreed fees on time. No refunds will be given unless required by law or at Tabinu's sole discretion.
If Tabinu offers subscription-based services, users will be informed of the pricing, billing cycle, and auto-renewal terms. Subscribers must cancel before renewal to avoid future charges.
Tabinu is an online facilitator that connects brands and influencers. We are not a party to any contract between a Brand and an Influencer; each campaign is a separate agreement directly between those users. Tabinu provides the platform and payment processing service only. For example, Influencify's terms explain that the platform "acts solely as an intermediary" and is the "authorized payment collection agent" for Influencers. Similarly, Tabinu cannot guarantee campaign outcomes, endorsements, or the accuracy of user-provided information. All negotiations, content creation, and campaign deliverables are solely the responsibility of the participating users.
Tabinu encourages parties to resolve disputes amicably. If a dispute arises, you may be required to notify Tabinu so we can assist in communication. However, Tabinu itself is not directly responsible for disputes between users. Some platforms (e.g. Influencify) require binding arbitration and waive class actions; Tabinu may include a similar clause (users should review any arbitration notice carefully). We will review any court or administrative orders related to disputes as required by law.
Tabinu's liability is limited to the fullest extent permitted by law. We provide the Service "AS IS" without warranties. We do not guarantee the performance or quality of any user or campaign. We are not liable for indirect or consequential losses (such as lost profits or data) arising from your use of Tabinu. Influencify's policy is illustrative: Tabinu is "not responsible for the conduct and behavior" of other users, and reserves no obligation to resolve user disputes. You agree that Tabinu's total liability (if any) in any situation will not exceed the fees you paid us for that transaction.
Tabinu may update or modify these Terms at any time. We will provide notice of material changes (for example, by posting them on the site or emailing users) before they take effect. Your continued use of Tabinu after the changes constitute your acceptance. (It is your responsibility to review the current Terms.)
Tabinu reserves the right to suspend or delete any account for violation of these Terms or for any other reason, with or without notice. If your account is terminated, your data and content may be removed. Tabinu also may discontinue or restrict the Service at any time (for example, for maintenance or new regulatory requirements) without liability to you.
These Terms are governed by the laws of the jurisdiction where Tabinu is based. For example, Influentials specifies Dutch law and courts. Tabinu will similarly identify a governing law (such as the state or country of its headquarters) and agree that disputes will be resolved in that forum. Unless prohibited by law, you consent to that chosen jurisdiction for any legal action.
By using Tabinu, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
